We obtained a judgment against the Town Council of Alaior for the injuries suffered during the horse festival.

Popular traditions are not above safety. When an event is organised with risks for attendees and those risks cause injuries, the Administration can also be held liable.


In this case, we obtained a favourable judgment in a public liability claim against the Town Council of Alaior for injuries suffered by an attendee during the well-known horse festival. The ruling was issued by the Administrative Court No. 2 of Palma de Mallorca, in Judgment 206/2025, dated 16 April 2025, with the involvement of the court representative Frederic Xavier Ruiz Galmés and legal defence by Ángel Aso Roldán.

The case arose from an accident that took place on 14 August 2016, at around 1:00 p.m., in the Plaza de la Constitución in Alaior, when a 72-year-old attendee was injured after an uncontrolled entry of riders and horses into the square. The crowding prevented her from leaving the area, and one of the horses stepped on her left foot, causing several injuries, which were assessed at €23,507.67.

The judgment fully upheld the claim, declared the administrative silence rejection null, recognised the Town Council’s liability, and ordered it to pay the claimant €23,507.67 plus statutory interest. No costs were awarded.

This case is particularly powerful for potential clients because it conveys a very clear message: when a public authority organises or permits a high-risk event, it cannot always rely on the victim’s conduct or on tradition as a defence. If the harm was foreseeable and safety measures were insufficient or inadequate, there may be grounds for a compensation claim.
